COLP and COFA SRA Service and Transparency Declarations 2021

Solicitors will recall that from the 6th of December 2018, SRA regulated legal firms must publish their fee information on their websites (or in alternative format easily available if they don’t have a website). To go with this, firms must publish the process for each of the different services offered, and the names, status and experience of the fee earners providing them.

There are also other requirements, such as the requirement to publish the firm’s complaints procedure and how and when clients should complain to the SRA or the Legal Ombudsman. And of course, the clickable Digital Badge must be displayed as well…

In their latest Compliance Bulletin, the SRA have said they will be writing to the COLPs and COFAs of the 8000 firms they have yet to write to and ask them to declare whether they are compliant with the requirements. They have already fined firms who are not compliant…

So if your firm has yet to publish its price information on its website, or if it doesn’t have one - in an alternative format, here’s a reminder of what needs to be published;

Services to individuals;

a)    The conveyance of residential real property or real estate which comprise:

                           i.          Freehold or leasehold sales or purchases; or
                          ii.          Mortgages or re-mortgages;

b)    The collection and distribution of money, property and other assets belonging to a person following their death, where these are within the UK and the matters are not contested;

c)     The preparation and submission of immigration applications, excluding asylum applications;

d)    The provision of advice and representation at the First-tier Tribunal (Immigration and Asylum Chamber) in relation to appeals against Home Office visa or immigration decisions, excluding asylum appeals;

e)    The provision of advice and representation at the Magistrates Court in relation to summary only road traffic offences dealt with at a single hearing;

f)      The provision of advice and representation to employees in relation to the bringing of claims before the Employment Tribunal against an employer for unfair dismissal or wrongful dismissal.

For services in relation to businesses, the requirements are:

a)    The provision of advice and representation to employers in relation to defending claims before the Employment Tribunal brought by an employee for unfair dismissal or wrongful dismissal;

b)    Debt recovery up to the value of £100,000;

c)     The provision of advice and assistance and representation in relation to licensing applications for business premises.

Remember the estimate or quote is not a binding fee, it is an indication, but even so should be as accurate as possible.

I gyd-fynd â hyn, rhaid i gwmnïau gyhoeddi'r broses ar gyfer pob un o'r gwahanol wasanaethau a gynigir, ac enwau, statws a phrofiad yr enillwyr ffioedd sy'n eu darparu.

Felly os nad yw'ch cwmni wedi cyhoeddi ei wybodaeth am brisiau ar ei wefan eto, neu os nad oes ganddo un - mewn fformat amgen, dyma atgoffa o'r hyn sydd angen ei gyhoeddi;

Gwasanaethau i unigolion;

a) Trawsgludiad eiddo preswyl go iawn neu eiddo tiriog sy'n cynnwys:

i. Gwerthiannau neu bryniannau rhydd-ddaliol neu brydlesol; neu
ii. Morgeisi neu ail-forgeisiau;

b) Casglu a dosbarthu arian, eiddo ac asedau eraill sy'n eiddo i berson yn dilyn ei farwolaeth, lle mae'r rhain yn y DU ac nad yw'r materion yn cael eu hymladd;

c) Paratoi a chyflwyno ceisiadau mewnfudo, ac eithrio ceisiadau am loches;

d) Darparu cyngor a chynrychiolaeth yn y Tribiwnlys Haen Gyntaf (Siambr Mewnfudo a Lloches) mewn perthynas ag apeliadau yn erbyn fisa'r Swyddfa Gartref neu benderfyniadau mewnfudo, ac eithrio apeliadau lloches;

e) Darparu cyngor a chynrychiolaeth yn y Llys Ynadon mewn perthynas â throseddau traffig ffordd cryno yn unig yr ymdrinnir â hwy mewn un gwrandawiad;

f) Darparu cyngor a chynrychiolaeth i weithwyr mewn perthynas â dwyn hawliadau gerbron y Tribiwnlys Cyflogaeth yn erbyn cyflogwr am ddiswyddiad annheg neu ddiswyddo ar gam.

Ar gyfer gwasanaethau mewn perthynas â busnesau, y gofynion yw:

a) Darparu cyngor a chynrychiolaeth i gyflogwyr mewn perthynas ag amddiffyn hawliadau gerbron y Tribiwnlys Cyflogaeth a ddygwyd gan weithiwr am ddiswyddiad annheg neu ddiswyddiad ar gam;

b) Adfer dyled hyd at werth £ 100,000;

c) Darparu cyngor a chymorth a chynrychiolaeth mewn perthynas â cheisiadau trwyddedu ar gyfer adeiladau busnes.

Cofiwch nad yw'r amcangyfrif neu'r dyfynbris yn ffi rwymol, mae'n arwydd, ond er hynny dylai fod mor gywir â phosibl.
